If the deceased’s children are also deceased, their grandchildren can also recover damages. If the deceased does not have a surviving spouse, child, or grandchild, the surviving parents and siblings or any other dependent relatives can recover damages. Finally, if the deceased has no surviving relatives that fall into these categories, any surviving family member may inherit the deceased’s estate, including a damages award from a wrongful death action.
